Acceptance of Terms of Usage

These Terms of Usage govern your access and use of the ButterflyGP.com website (AKA "Site," "we," and "us"). By accessing or using this website, you agree to be bound by these Terms, including any additional guidelines, restrictions, or rules that may be posted in connection with specific sections or services of this site. All additional guidelines are hereby incorporated by reference.

If you disagree with any part of these Terms, please do not use this Site.

General

ButterflyGP.com reserves the right to modify this site and these Terms of Usage at any time without prior notice. You are responsible for reviewing these Terms periodically. If you disagree with any terms, please refrain from using the site or placing orders.

All orders are subject to acceptance by ButterflyGP.com. We reserve the right to refuse or cancel any order at any time. If an order is cancelled after payment, depending on which step of the production it is, a refund may be possible (contact customer support for more information). Prices are subject to change before order acceptance.

By using our Site, you consent to receive legal notices, correspondences, offers, deals and other communications electronically, either via email or posted on the website.

Customer Responsibility

You are responsible for reviewing and approving all proofs, designs, and content before placing an order. Once you submit an order, no changes can be made. We are not liable for errors in the final product resulting from your approval.

You must ensure that any artwork, images, and content you submit are correct and free of errors. ButterflyGP.com is not responsible for any mistakes in artwork, including spelling errors, incorrect graphics, or poor resolution. All artwork must be submitted in CMYK format and a minimum resolution of 300 DPI. ButterflyGP.com is not responsible for colour discrepancies between proofs and final prints due to RGB-to-CMYK conversion.

Credit Card

If the buyer’s credit card is declined, ButterflyGP.com will not process the order. If the order has already been shipped and the buyer’s payment is overdue, a monthly finance charge of 2% (24% per year) will be applied to the unpaid balance. If payments are not made by the due date, future orders will require advance payment unless other arrangements are made. If ButterflyGP.com needs to take legal action to enforce this agreement, the buyer agrees to cover reasonable legal fees and costs.

Copyright and Content Use

You affirm that you have the necessary rights to use all content you submit for printing. This includes text, logos, images, and any other materials. You are responsible for ensuring that your content does not infringe on any intellectual property rights. At the same time, all materials on the Site are protected by copyright, and you may not reproduce or redistribute any of this material without permission.

You agree not to upload or submit content that is illegal, obscene, defamatory, infringing, or violates the rights of others. This includes, but is not limited to, child pornography, threats, and illegal substances. You also agree to indemnify ButterflyGP.com and hold us harmless from any legal claims arising from the content you provide, including any infringement of copyright, trademarks, or other proprietary rights.

While we do not actively pre-screen customer content, we reserve the right to remove any content that violates these Terms or is deemed objectionable.

Legal Compliance

These Terms are governed by the laws of the Province of Ontario, Canada. Any legal disputes arising from the use of this Site will be resolved in the courts located in Ontario. If you use the Site outside of Canada, you agree to comply with applicable local laws, including those governing intellectual property and online conduct.

Limitation of Liability

While we make every effort to ensure timely delivery, we are not liable for delays caused by circumstances beyond our control, including but not limited to shipping delays, equipment failure, or Acts of God. In no event shall ButterflyGP.com be liable to anyone for any kind of financial losses, cost, expenses, damages and/or other economic damages.

The buyer agrees not to hold ButterflyGP.com responsible for any losses, costs, or damages (including legal fees) if any claims or legal actions are made against ButterflyGP.com or its affiliated companies. This includes claims that the work/print product violates copyrights, trademarks, or privacy rights, or is offensive.

Cancellations and Refunds

Orders can be cancelled before they are processed and go into production. ButterflyGP.com and its affiliated company will not refund any money for the orders that were shipped or were cancelled after the order was processed. Order will be reprinted if the fault is on us.

Payment and Billing

Payments are processed through Stripe or PayPal. We do not store any credit card information. Payments are securely processed by third-party providers. We do not accept returns on products unless the item is defective or the order was printed/processed incorrectly due to a mistake on our part.

Shipping and Delivery

Turnaround times (production times) are estimates. ButterflyGP.com is not responsible for delays caused by shipping carriers or external factors such as weather or customs. If a package is returned due to an incorrect address provided by the customer, we will reship the package at the customer’s expense.

Miscellaneous

ButterflyGP.com is not responsible for any content or services provided by third-party websites linked to from this Site. We are not liable for any failure to perform due to unforeseen events beyond our control (force majeure), such as natural disasters, government actions, or other external causes.
